    At 6:00 PM, Regional Director Mark Anderson, local representative of the New York State Fire Prevention and Codes Division, offered a presentation on the importance of codes enforcement, with particular focus on the new statewide codes.  The discussion was very informational.  Contact number for Mr. Anderson is 845-334-9373 or by e-mail - http://www.dos.state.ny.us.

    Mayor Slatin opened the regular village board meeting at 7:00 PM.

    Fred Doyle, seconded by Joan Hinman, made a motion to table the approval of the October 16, 2007, minutes, until corrections could be made.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    Fred Doyle, seconded by Joan Hinman, made a motion, to approve the purchase of a 455 Husky chainsaw needed for Stamford Fire Department. in the amount of $345.00.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    Fred Doyle, seconded by Joan Hinman, made a motion to approve the application of Joseph Hornbeck and Jacob Scully for emergency status into the Stamford Fire Department.  Doyle-yes, Hinman-yes, Jacobs-yes

    A motion was made by Fred Doyle, seconded by Joan Hinman, to approve an agreement with Delaware Operations, Inc., allowing the Stamford Village Wastewater Treatment Plant to become the primary facility for the treating and disposing of the DMV International pretreatment facilities sludge. 

    The projected annual revenue when taking 75% of DMV’s sludge:

    Estimated sludge volume:  750,000 gallons or approximately 88 loads.
    Estimated revenue:   $26,250.00
    Estimated cost of processing and disposal:  $4,480.00.
    Estimated profit: $21,410.00

    Fred Doyle, seconded by Joan Hinman, made a motion to authorize the mayor’s signature on the Village of Stamford’s SPDES permit, increasing the legal processing limit at the WWTP from 500,000 gallons per day to 750,000 per day, on a monthly average.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    Fred Doyle, seconded by Donna Jacobs, made a motion to correct Mark Cierone’s recent water bill of $252.75 (Account #3810) and charge the minimum of $37.50.  Consistently his water bill has been the minimal charge for each quarter.  Supervisor Joe Hornbeck found that the meter head was faulty.  Motion passed.  Doyle-yes, Jacobs-yes, Hinman-yes

    Fred Doyle, seconded by Joan Hinman, made a motion to correct the water bill of John McLean, Account #0455, to revert to the minimal charge of $37.50.  The bill reflected water usage of 65500 gallons, and it should have read 6550.  Motion approved.  Doyle-yes, Hinman-yes, Jacob-yes

    Fred Doyle, seconded by Joan Hinman, made a motion to accept the proposal from Mirabito Fuel Group for the installation of a gas pump at the village barn.  They will furnish and install for a 300-gallon double walled gasoline fuel tank (primed) with a Gasboy 1820 electric pump and trim for the village barn on Railroad Avenue.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    Joe Hornbeck presented three quotes received for dead/dying tree removal.  Quotes were as follows:  All-Season Tree Service $5,500.00, Beaver Tree Service $8,000.00, and Clean-Cut Tree and Snow Service $3,800.00

    A motion was made by Fred Doyle, seconded by Joan Hinman, to approve the proposal from Clean-Cut Tree & Snow Service for the removal and clean-up of 18 trees and one trim, for $3800.00.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    Joan Hinman, seconded by Fred Doyle, made a motion to approve the purchase of a new computer for the village shop, with expenditure of $1000.00 or less.  Motion passed.  Hinman-yes, Doyle-yes, Jacobs-yes

    Fred Doyle, seconded Joan Hinman, made a motion to clarify and amend the existing schedule of Fire Inspection Fees.  Changes were #4 – “per Inspection per rental unit”, #5 to – “per business” (key word ‘All’ to ‘Each’) and #6 ‘All’ to ‘Each.’  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    Fred Doyle, seconded by Joan Hinman, made a motion to authorize the mayor’s signature on an appearance ticket to be served on Joseph Decelis, regarding his alleged violation of the Village of Stamford’s Dog Ordinance.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    Joan Hinman, seconded by Fred Doyle, made a motion to approve the Village of Stamford Park Use form for Edward Stammel, Assistant District Commissioner, Foothills District, Otschodela Council Boy Scouts of America, for the use of Archibald Field, in February 2008.   Motion approved pending insurance approval.  Hinman-yes, Doyle-yes, Jacobs-yes

    Fred Doyle, seconded by Joan Hinman, made a motion to authorize the mayor’s signature on a Certificate of Substantial Completion, Project Infiltration & Inflow Remediation, and VS8-G-2006.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    A motion was made by Fred Doyle, seconded by Joan Hinman, to approve change order #1, Village of Stamford Infiltration & Inflow Remediation Project, contract # VS8-G-2006, decrease of $1,250.00.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-yes

    Joan Hinman, seconded by Fred Doyle, made a motion, to accept the $1,000.00 grant received from the Robinson-Broadhurst Foundation, Inc., into the general fund for the planting of SVIA’s shrubs and perennial flowering plants in the Headwaters mini-park.  Motion passed.  Hinman-yes, Doyle-yes, Jacobs-yes

    Fred Doyle, seconded by Joan Hinman, made a motion to authorize payment of Abstract #6.  Motion passed.  Doyle-yes, Hinman-yes,  Jacobs-yes

    A motion was made by Joan Hinman, seconded by Fred Doyle, for the Village Board to go into Executive Session to discuss a personnel issue. Cliff Mueller, Stamford Fire Chief and Jerry Warner EMS Chief were invited to stay.  Motion passed.  Hinman-yes, Doyle-yes, Jacobs-yes
    Village Board came out of executive session.

    A motion was made by Fred Doyle, seconded by Joan Hinman, to approve Christy Hubbard’s application into the Stamford Fire Department, emergency status.  Motion passed.  Doyle-yes, Hinman-yes, Jacobs-Yes.

    BOIL WATER UPDATE #2

    The village had a second water sample drawn today, which was sent to the NYSDOH for the mandated testing. We are hoping to be able to lift the BOIL WATER ORDER tomorrow.     BOIL WATER UPDATE

    Dear Residents and Business Owners,

    Alas, I have no good news for you. The “boil water notice” is still in effect.

    Before the boil water notice can end, two water samples (taken 24 hours apart) need to be lifted & tested by an independent lab. The results then are sent to the NYS Health Department in Oneonta. Once that is done, and the health department determines that bacteria levels are OK, then we can lift the notice.

    Our hard-working village employees spent a great deal of time yesterday (Friday) trying to get an independent licensed technician to come to Stamford to take the samples. If a sample had been taken yesterday, and one today, it might have meant that the health department could instruct us to lift the notice on Monday.

    Unfortunately, not one testing lab (FIVE were called) would come to Stamford on Friday (yesterday) to do this, and none of the labs will work on the weekend. Some labs claimed emergencies, others were just too busy.

    That said, I don’t believe the boil water notice will be lifted until Wednesday.

    Aside from our inconvenienced residents, I am especially concerned for our restaurants in the village, as hunting season opens this weekend, and the place is chock full of hunters. I believe it must be a burden to have to buy bottled water for beverages, but nothing can be done until those water samples are taken and analyzed. We are at the mercy of the testing labs.

    I am sorry for the hardships that we all are facing, due to this unanticipated emergency. The water main break was at the trailer park at the top of River Street. I have been told that we lost at least 300,000 gallons of water. The break has been repaired.

    BOIL WATER NOTICE IN STAMFORD UNTIL FURTHER NOTICE

    Due to a large water main break in the Village of Stamford, the NY State Department of Health has ordered that all village tap water be boiled prior to consumption. The village is working right now to fix the break, but the Health Department will have to test the water before the order can be lifted, which could take several days.

    While a notice to boil water is in effect, changes must be make in the ordinary use and consumption of tap water for food preparation, personal hygiene, and domestic use.

    There is no indication right now that the village water is contaminated, which can be determined only by health department testing. However, EPA and NY State law require public notification to all water customers of a boil water notice, because this condition is a health risk.

    To ensure destruction of all possible harmful bacteria and other microbes, water for drinking, cooking, and making ice should be boiled. The water should be brought to a vigorous rolling boil and then boiled for two minutes. In lieu of boiling, you may purchase bottled water or obtain water from some other suitable source.

    Use boiled or bottled water for brushing teeth and rinsing the mouth. When taking a shower or a bath, take care to avoid swallowing the water. Hand-wash infants to prevent them from swallowing water or putting wet toys into their mouths.

    Boiled or bottled water should be used for preparing beverages, washing fruits and vegetables that will be eaten raw, making ice cubes, preparing dishes and food for cooking.

    Boiled water, stored in sterilized, air-tight containers will usually keep for up to three days in the refrigerator, or for 24 hours at room temperature.

    When it is no longer necessary to boil water, a notice will be published to let citizens know that the water is safe for consumption.

    Dog Control Law

    Local Law No. 1 of the Year 2006  
    DOG CONTROL LAW

    SECTION 1:  PURPOSE
    The Village Board of the Village of Stamford finds that the uncontrolled behavior of licensed and unlicensed dogs has caused physical harm to persons, damage to property and has created nuisances within the Village.  The purpose of this Local Law is to protect the health, safety, and well-being of persons and property by imposing restrictions on the keeping of dogs within the Village and to set forth penalties for violations.

    SECTION 2:  AUTHORITY
    This Local Law is enacted pursuant to the provisions of Section 124 of Article 7 of the New York State Agriculture and Markets Law. 

    SECTION 3:  DEFINITIONS
    DOG:  Any member of the species Canis Familiaris. 
    DOG CONTROL OFFICER:  Any individual appointed by the Village of Stamford Board of Trustees to assist in the enforcement of this Local Law and Article 7 of the New York State Agriculture and Markets Law. 
    HARBOR:  To provide food or shelter to a dog. 
    IDENTIFICATION TAG:  A tag that sets forth an official identification number as required by the New York State Department of Agriculture and Markets. 
    IDENTIFIED DOG:  Any dog carrying an identification tag as provided by the New York State Department of Agriculture and Markets. 
    OWNER:  Any person who owns, harbors or has custody and control of a dog. 
    OWNER OF RECORD:  Any person in whose name any dog was first licensed pursuant to either Subdivision One or Subdivision Two of Section 109, of the New York State Department of Agriculture and Markets Law, except, however, that if any license is issued to a person under sixteen years of age, the owner of record shall be deemed to be a parent or guardian of such person. 
    PERSON:  Any individual, corporation, partnership, association, or other organized group of persons, or other legal entity. 
    VICIOUS DOG:  Any dog that constitutes a physical threat to human beings or other animals. 

    SECTION 4:  PROHIBITIONS
    It shall be unlawful for an owner of any dog to allow or permit such dog to:

    1. Go or be upon any private property, other than the property owned or occupied by the owner or other person having the care, custody, or charge of such dog, without the knowledge and consent of the owner or occupant of such private property; or 
    2. Be permitted in any of the streets or public places of the Village of Stamford unless it is effectively restrained by a chain or leash not exceeding six (6) feet in length and is attended by a person of adequate age and discretion to control its actions; or 
    3. Engage in howling, barking or crying, for more than 30 minutes, in such a manner and to such an extent as to be annoying or disturbing to any person or persons other than the owner or harborer of such dog; or
    4. Cause damage or destruction to property or to commit a nuisance upon the premises of any person other than the owner or harborer of such dog; or
    5. While off the owner’s property, chase, jump upon or at, or otherwise harass any person in such a manner as to reasonably cause intimidation or fear or to put such person in reasonable apprehension of bodily harm or injury; or
    6. Be left out of doors before 7:00 AM or after 9:00 PM, without the direct supervision of its owner, or an agent of its owner; or
    7. Defecate on any sidewalk, street, park, public area or private property of another person.  It shall be the duty of the owner or harborer of such dog to remove and dispose of any feces left by the dog. 

    SECTION 5:  ENFORCEMENT
    This Local Law shall be enforced by any Dog Control Officer, or peace officer, when acting pursuant to his special duties, or member of the sheriff’s department or state police.
     
    SECTION 6:  APPEARANCE TICKETS
    Any Dog Control Officer, or peace officer, when acting pursuant to his special duties, in the employment or under contract with the Village of Stamford, or any police officer, observing a violation hereof in his presence shall issue and serve an appearance ticket for such violation.
     
    SECTION 7:  PENALTIES
    Any person convicted of a violation of this Local Law shall be liable to a penalty of $50.00 for the first offense; $100.00 for the second offense of this law within a five-year period; and $150.00 for the third violation of this law within a five-year period, and for any subsequent violations within a five-year period, the fine shall not be less than $100.00.

    SECTION 8:  LIABILITY
    No officer, agent or employee of the Village of Stamford shall render himself personally liable for any damage that may accrue to persons or property as a result of any act required or permitted in the discharge of his duties under this Article.  Any suit brought against any officer, agent or employee of the Village of Stamford, as the result of any act required or permitted in the discharge of his duties under this Article, shall be defended by the Village Attorney until the final determination of the proceedings thereon.
     
    SECTION 9:  SEPARABILITY
    This Local Law shall supercede all prior local laws, rules and regulations relative to the control of dogs within the Village of Stamford, and they shall be, upon the effective date of this law, null and void. 

    SECTION 10:  EFFECTIVE DATE
    This Local Law shall go into effect as soon as it is filed with the Secretary of State of the State of New York.
